In making this purchase you are deemed to have read and agreed to the following terms and conditions:
1. DEFINITIONS
1.1 “Buyer” means an individual or organisation that purchases goods from the Seller for personal or professional or any other use.
1.2 “Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods described in these Terms and Conditions.
1.3 “Goods” means the items the Buyer agrees to buy from the Seller.
1.4 “Seller” refers to National Association of Seadogs.
1.5 “Terms and Conditions” means the terms and conditions described in this document.
2. CONDITIONS
2.1 The terms and conditions described shall not affect the Buyers rights under the governing law of this contract of sale.
2.2 These terms and conditions will be applied to all sales between the Seller and the Buyer.
2.3 Any variation of these Terms and Conditions must be agreed upon between the Buyer and Seller and given in writing by the Seller prior to any purchase.
3. ORDERING
3.1 These terms and conditions shall govern all items purchased by the buyer and the buyer hereby agrees to be bound by all the terms and conditions herein contained.
3.2 The Seller reserves the right to refuse any order for any reason whatsoever.
4. PRICE AND PAYMENT
4.1 The price of the Goods is as shown on our Website. The price excludes cost of delivery and any applicable statutory tax.
4.2 The total price, including VAT and delivery charges will be shown in the Buyers shopping cart at checkout.
4.3 Payment for goods must be received together with freight and handling charges before any item can be made and dispatched.
4.4 The Seller accepts payment for orders through PayPal, bank transfer or cash deposit into Sellers bank account as per details the seller will give to the buyer. The Seller reserves the right to refuse payment by any other method.
4.5 All goods remain the property of the seller until paid for in full. Any money that remains outstanding by the due date shall will incur late payment interest at the prevailing rate of 2% above the prevailing Central Bank of Nigeria’s base rate on the outstanding balance until such a time as the balance is paid in full and final settlement..
. Acceptance by Seller or its bankers of any such payment does not constitute an acceptance of the customer’s offer by the Seller. All invoices must be paid within 48 hours.
4.6 All payments are to be made by the Buyer in any PayPal approved currency and the current exchange rate shall apply.
4.7 The buyer hereby warrants that all information provided by him in making this purchase is accurate and hereby releases the seller from all claims howsoever arising for loss or any delay caused by any incomplete or inaccurate credit card or other billing information supplied by the buyer in making the purchase.
5. RIGHTS OF SELLER
5.1 The Seller reserves the right to change the products, price and specification of any item on the Website at its discretion.
5.2 The Seller reserves the right to withdraw any goods from the Website at anytime or replace it with a like item.
5.3 The Seller shall not be liable to anyone for withdrawing any goods from the Website or for refusing to process an order.
5.4 The Seller reserves the right to cancel the order if an unsatisfactory photograph or information is supplied for transfer to the purchased item buy the Buyer.
6. WARRANTY
6.1 The Seller warrants that the Goods will at the time of dispatch match up to the description given on the website. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyer’s purpose.
7. DELIVERY
7.1 Goods to supplied and shipped by courier or other expedited mail service shall be normally be delivered within 7 working days of order.
7.2 Goods shipped by normal postage will normally be delivered within 21 working days of payment for order.
7.3 The Seller reserves the right to alter delivery times without notice.
7.4 Where a specific delivery date has been agreed, and where this delivery date cannot be met, the Buyer will be notified and given the opportunity to agree a new delivery date or receive a full refund.
7.5 The Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
7.6 Delivery of the Goods shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
7.7 Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
7.8 The Seller will not be liable for any loss of the goods as a result of the Buyer providing a wrong address for delivery.
8. TAXES AND CUSTOMS
8.1 The Seller shall pay all taxes which may be payable in respect of the sale of the goods pursuant to the laws of Nigeria The Buyer shall pay all other governmental charges in respect of the sale, transport or importation of the goods or any transaction in relation thereto.
8.2 The customer is solely responsible for ensuring that all laws of the country to which the goods are to be delivered and which are applicable to the goods or any transaction in relation thereto are satisfied and indemnifies National Association of Seadogs in relation to any liability arising therefrom.
9. CANCELLATION AND RETURN POLICY
9.1 The Buyer will contact the Seller by email within 24hours if they wish to cancel their order. Orders cannot be cancelled after this time for all goods requiring customization as to image and/or message may have been applied to the ordered goods during this time.
9.2 The Buyer must inspect the goods immediately upon receipt and shall notify the Seller by phone or email within 48hours of delivery of the goods if there are any problems with the order or is not satisfied. All possible efforts will be made to correct any problems with the order within a reasonable time period at the discretion of the Seller.
9.3 Where an item is returned to the Seller by the Buyer, the Buyer will be entitled to return postage compensation. Items must be returned as a recorded delivery, with delivery signature obtained and receipt for postage must be obtained also and presented to the Seller to entitle a refund of postage to the Buyer.
9.4 The Seller will not be held liable for any returned goods being lost or damaged when the Buyer is returning an item to the Seller for a refund.
9.5 A refund will not be issued until the returned item is received.
9.6 The Seller will not accept any return(s) prior to communication between the Buyer and the Seller being established as to the severity or type of problem experienced with the goods supplied.
9.7. The Seller will hold no responsibility for incorrect spelling or images engraved when supplied by the customer. (Please ensure correct information is sent as no refunds will be given).
10. WAIVER
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
11. FORCE MAJEURE
The Seller will not be held liable for any delay or the failure to supply goods for any of the following reasons; acts of God, strikes, lock outs, breakdown of machinery, accidents, war, terrorism, earthquake, floods and any other reason beyond the Sellers control.
12. CHANGES TO TERMS AND CONDITIONS
The Seller shall be entitled to alter these Terms and Conditions at any time. But this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
13. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with Nigerian Law and the parties hereby submit to the exclusive jurisdiction of Nigerian courts.
